1. Purpose

These Terms of Use regulate the use (including mere access) of the CETaqua website, including the contents and services provided on it. Anyone accessing this website is deemed to be a “User” and expressly, automatically and voluntarily agrees to abide by the applicable general terms of use when he/she accesses the aforesaid website as well as any special terms that may be applicable.
In any event CETaqua reserves the right to unilaterally modify the website’s structure and design at any time and without notice, and to modify or remove services or contents or to change the terms applicable to any access to and use of the website.

2. Use of the website

Unless otherwise specified in the Special Terms of Use, use of this website will be free of charge, without prejudice to the cost of the connection via the telecommunications network used by the User.
The User is aware and voluntarily and expressly agrees that his/her use of this website is under his/her sole and exclusive liability.
The User undertakes to use this website and its services and contents without breaching current legislation, good faith, generally accepted practice and public order. Moreover this website may not be used for unlawful purposes or in a way detrimental to CETaqua or any third party.
In using the website the User undertakes not to behave in any way that may harm the image, interests and/or rights of CETaqua and/or of third parties, or that might damage, make unfit for use or overload the website, or in any way prevent the website’s normal use.
CETaqua takes reasonable security measures to detect the presence of viruses. But the User should be aware that security measures in computer systems on the internet are not wholly reliable, and therefore that CETaqua cannot guarantee the absence of viruses or other elements that may disrupt the User’s computer systems (software and hardware) or the electronic documents and files contained therein.

3. Industrial and intellectual property rights

All industrial and intellectual property rights and all the information contained on this website (images, graphics, source code, design, navigation structure, databases and other contents appearing therein) are CETaqua’s sole property.
These Terms of Use grant no intellectual or industrial property rights over this website or any of its integral parts (images, graphics, source code, design, navigation structure, databases and other contents appearing therein), and the User may not reproduce, transform, distribute, publicly communicate, provide, extract, reuse, forward or in any other way use any of them, by any means or procedure, except where legally permitted or expressly authorized in writing by the holder of the relevant rights.
The User is authorized only to view and make temporary private copies of the site’s contents for personal and private use on his/her computer systems (software and hardware), which may not be subsequently transferred to third parties. With the above proviso, the User may not modify or reproduce this information, in whole or in part, without CETaqua’s prior written consent. By way of example and without limitation:
1) The User is not authorized to use the information contained on the site for the purposes of commercial or professional activities (direct sales or any other commercial purposes, or marketing the information in any way);
2) The User is not authorized to delete, evade or manipulate the copyright or other data identifying CETaqua’s rights, or any protective mechanisms.
4) The User is not authorized to reverse-assemble, reverse-compile or reverse-engineer the databases in which the site’s data is stored.
All the information on this website is protected by copyright. Any unauthorized use of the data on the website, resale thereof or breach of CETaqua’s intellectual or industrial property rights will give rise to the legally established liabilities.
The trade marks (distinctive marks and logos) appearing on the website are CETaqua’s sole property and are duly registered or in process of registration. Names of other products, services and companies appearing in this document or on the site may be trade marks or other distinctive marks registered by their respective and legitimate owners.

4. Disclaimer of warranty and liability

CETaqua is not liable for any damages arising from the use of content on its website. In particular CETaqua is not liable for the content or state of the links on this site, and that may lead the User to other websites managed by third parties. CETaqua is not liable either for the content or for the state of such websites. Any access thereto through this site does not imply that CETaqua recommends or approves their contents.
Abgar is not liable for any deficiencies in the service from its server or in communications networks, or for any problems resulting from browser malfunctions or the use of non-optimized browser versions.
Access to this website and any use made of the information contained therein are under the sole liability of the accessor or user. CETaqua will not be liable for any damages or consequences that might result from such access or use of information. CETaqua is not liable for any security errors that may occur or any damage that may be caused in the User’s computer system (hardware and software) or in the files and documents stored therein as a result of the presence of viruses in the User’s computer used to access the services and site contents, or of browser malfunctions or the use of non-optimized browser versions.

5. Hyperlinks and linked sites

The User and, generally speaking, any individual or entity intending to provide a hyperlink or technical linking device (e.g. link or button) from its website to CETaqua’s website must obtain prior written authorization from CETaqua.
The establishment of a hyperlink does not in any event entail the existence of a relationship between CETaqua and the owner of the website on which the link is provided, or CETaqua’s acceptance or approval of its contents or services.
In all events CETaqua reserves the right at any time to block or disable any hyperlink to its website, especially in the events of unlawful activity or content in the website on which the link appears.
The CETaqua website offers the User hyperlinks or technical linking devices (e.g. links or buttons) giving access to websites or internet portals owned or managed by third parties (“Linked Sites”) solely for the purposes of finding and accessing information, contents and services available on the internet.
CETaqua does not, either itself or through third parties, offer or market the information, contents and services available on such Linked Sites, or approve, supervise or in any way monitor those contents and services or any material of any kind appearing therein, and the User is solely liable for his/her navigation on them.

6. Applicable law and jurisdiction

These Terms of Use will be subject to Spanish law.
CETaqua and the User expressly waive any other jurisdiction and submit to the courts and tribunals of the city of Barcelona for any issues or actions that may arise in connection with the service provided by this website and its services and contents, or with the construction, application, fulfilment or non-fulfilment of what is specified here.
